What is FoSCos / FSSAI Food License?

The Food Safety and Standards Authority of India (FSSAI), established under the Ministry of Health & Family Welfare, Government of India, is the regulatory body for food products. Since June 1st, 2020, FSSAI has utilized the Food Safety Compliance System (FoSCoS), which replaced the previous licensing and registration platform. Obtaining an FSSAI License or Registration Certificate is mandatory for any business involved in the manufacture, distribution, or transport of food products, ensuring quality and purity for consumer confidence.

What is FSSAI Registration?

FSSAI Registration (Food License) is a legal permit from the Food Safety and Standards Authority of India. It shows your food business meets the required safety and quality standards. It’s mandatory for anyone who makes, processes, packs, stores, transports, distributes, or sells food in India.

Three Types of FSSAI Registration in India

Choose the right FSSAI registration type for your food business:

1. Basic FSSAI Registration

This registration applies to small food businesses with an annual turnover below Rs. 12 lakhs. The government gives you a 14-digit number starting with ‘1’.

Example: Home kitchen or small food stall.

2. State FSSAI License

This license is issued to food businesses with an annual turnover between Rs. 12 lakhs and Rs. 20 crores, and the license number begins with the digit ‘2’.

Example: A restaurant or food shop.

3. Central FSSAI License

Big food businesses earning over Rs. 20 crores require a central FSSAI license with a number starting with ‘1’.

Example: Food operations across multiple states.

Why is Renewal Important?

An FSSAI license is valid for a period of 1 to 5 years. It must be renewed 30 days before the expiry date. If you fail to renew on time, you may be charged a penalty of ₹100 per day. If the license expires completely, you must apply for a brand-new license and stop operations in the meantime.

What is the FSSAI Modification process ?

Following the FSSAI FoSCoS registration procedure, any registered Food Business Operator (FBO) can change, alter, or modify any given information in the Food License issued by the authority. This particular process is known as the FSSAI Modification.

When do you need Modification?

If there is any change in your existing license information, you must file for a modification. This includes:

  • Change in Business Address or Location.

  • Change in Ownership or Company Name.

  • Adding New Food Products or categories.

  • Changing the Quantity of production or business scale.

 

Points to be Remembered

  • The concerned FBO can select a single Modification Category at a time in the FSSAI Modification process, as regulated by the Food Licensing authority
  • Food Manufacturers/Processors who have already obtained a Food License but in a wrong category, are required to get their License Modified
  • For adding a new business, change of business address, change in contact details, or change in the product category – an FBO is requisite to file for FSSAI License Modification
  • The FSSAI Designated Officer (D.O.) is responsible to scrutinize the Modification Application and the D.O. may seek any clarification from the FBO. The query is needed to be responded within the next 30 days

Who Must File Annual Returns?

Every food business operator (except petty retailers and small canteens) holding an FSSAI License is mandatory required to file an Annual Return. This includes manufacturers, importers, and exporters.

Types of Return Forms

  • Form D1 (Annual Return): To be filed by all food manufacturers and importers by 31st May every year.

  • Form D2 (Half-Yearly Return): Specifically for businesses involved in the manufacturing or distribution of Milk and Milk Products.

 

Details required for Filling Annual Return Form:

The below-mentioned details are required to be included in the FSSAI Annual Return Form, are as follows:-

  • Name of the Food product which is being manufactured, exported, imported, or handled.
  • Bottle size, can size or size of any other packaging.
  • Quantity in the metric ton.
  • Value of Food product.
  • Quantity in Kg which is being exported or imported.
  • Selling price per unit of packaging or per kg.
  • Name of the countries to where food products are exported.
  • Rate per unit or kg of packaging CIF/FOB/
  • Mandatory Last FSSAI Annual Returns.
